  • Header Statement

    The terms and conditions (“Program Rules”) provided herein will apply to the Wellborn Cabinet Rewards Program (“Program”) offered by Wellborn Cabinet, Inc. (“WB”).

  • Eligibility

    Designers (as defined herein) who are approved by a participating, qualified dealer(s) of WB, have a WB Designer ID, are legal residents of the 50 United States, the District of Columbia or Puerto Rico, are 18 years of age and older at the time of enrollment, and provide a United States Social Security Number are eligible to participate in the Program.

    If a Designer leaves his/her employment with a participating, qualified WB dealer for any reason, his/her accumulated rewards will be available for up to 24 months from the date of his/her enrollment date in the Program. After this 24-month period, all rewards earned in the Designer’s Program account will expire and be forfeited and his/her account will be cancelled. However, if within this 24-month period, the Designer is employed by another participating, qualified WB dealer and contacts hmccain@wellborn.com, his/her existing Designer ID may be transferred to the new dealer and accumulated rewards may be transferred to his/her new Program account.

    If a Designer does not make a qualifying order under this Program for 12 months, the Designer’s Program account with WB will be cancelled (re-registration will be necessary to participate in the program).

  • Registration

    Designers must be pre-registered with a WB Designer ID to participate in the Program. Designer’s eligibility with a dealer will be verified and an email will be sent to the Designer with a Designer ID# and directions to access the Program rewards site and complete registration. Each Designer must consent to the Program Rules upon enrollment and must submit his or her Social Security Number (for US IRS tax filing purposes) to perform various actions under the Program (e.g. receive rewards, review transaction history, generate a rewards Program customer service inquiry).

    Any changes to the Designer’s personal information, such as name and address, are the Designer’s responsibility and must be made by contacting hmccain@wellborn.com. Name changes must be supported by legal documentation, signature, and date. WB is not liable for misdirected, lost, or stolen mail.

    A Designer’s registration and membership in the Program constitutes his or her full and unconditional agreement to and acceptance of these Program Rules and the decisions of WB, which are final and binding.

  • Designer’s Account

    The Designer is responsible for maintaining the confidentiality or security of his or her account and password and for restricting access to the Designer’s computer. The Designer agrees to accept full responsibility for all activities that occur under his or her account or password. The Designer also agrees to immediately notify WB of any unauthorized use thereof. WB reserves the right at all times and for any reason to modify or refuse the Designer’s use of the Program site, including, but not limited to, the ability to terminate the account or Program, remove, change or edit content or products offered, and/or cancel orders at its sole discretion.

    WB reserves the right to disqualify, revoke, or suspend any Designer from participating in the Program and/or to cancel or void any Program benefits (e.g., prepaid cards) at any time without notice and with immediate effect if, in its sole discretion, WB determines that the Designer has (1) entered invalid or fraudulent information or submissions; (2) has abused, received, or redeemed Program benefits through fraud, theft, or otherwise illegal means; (3) engaged in hostile, abusive, or inappropriate conduct toward WB, its employees, agents, or representatives; (4) if applicable, failed to pay WB in accordance with WB’s payment terms; or (5) has otherwise violated these Program Rules. These rights are in addition to any other legal or equitable remedies which may be available to WB under applicable law.

  • Earning Rewards

    Registered Designers will be issued rewards for eligible invoices of eligible Wellborn Cabinet products (as defined in “Eligible Products” section of Program Rules) on a Wellborn Rewards Visa® Prepaid Card.

    Rewards are loaded monthly based on orders invoiced in the prior month. Example: orders invoiced in Feb will be added to Designer’s Wellborn Rewards Visa® Prepaid Card in March.

    Reward values are subject to change. Rewards and Designer IDs may not be transferred or assigned.

    Please allow 7-10 business days for your new card with initial reward funds to arrive via 1st Class Mail. Please allow up to 2-3 business days for subsequent reward funds to reload on your current card. Card terms and conditions apply*.

    *Card is issued by MetaBank®, Member FDIC, pursuant to a license from Visa U.S.A. Inc. No cash access or recurring payments. Can be used everywhere Visa debit cards are accepted.   • Eligible Sales

    Registered Designers will be issued rewards for selling eligible WB Cabinet Boxes (as defined below) from the following product lines: Estate, Premier, Select, Aspire, Elegant Bath and Wellborn Closets

    Rewards for eligible sales will begin calculating after Designer is verified for program pre-registration and receives a WB Designer ID. Rewards will not be paid out until Designer completes rewards account registration (must consent to the Program Rules upon enrollment and must submit his or her Social Security Number).

    An eligible “Cabinet Box” means any SKU that is 3-dimensional with volume that has space requirements and is not included inside another box. A Cabinet Box does not include parts, trim items, mouldings, accessories, sample fronts, etc

    A sale will be eligible for this Program only if the participant adds his/her Designer ID to the order at the time of placement of the order. Only one Designer ID may be put on each order, and only one Designer will earn rewards for any one order.

    Sales of various cabinets are ineligible for this Program and will not earn any rewards. Participants should not add their Designer ID to such orders. These include, but are not limited to: Display Orders, Contract Jobs, Special price quoted projects, Samples, Model or Parade of Homes, Warranty, PRP and Builder Rewards.

    Any incomplete orders will be considered void. All orders are subject to review, audit and further proof of reward eligibility, including but not limited to payment in full for the order.

    Any technical disputes on any order must be initiated by the Program participant within 90 days of the invoice date by contacting Hattie McCain, Credit Program Analyst. Only disputes that are Wellborn system errors will be reviewed. There will be no adding of Designer ID Numbers to orders after order submittal unless it was a Wellborn system error.

  • Taxes

    The value of all rewards earned in this Program is considered taxable income. Designers are responsible to pay applicable federal, state, and local taxes. For tax and reporting purposes, an IRS 1099 form will be mailed to the Designer in accordance with IRS rules & guidelines if the value of all rewards received during a calendar year exceeds $599.99.

  • Customer Service

    Customer Service support for the Program is available via phone or email. Registered Designers can contact Customer Service at (855) 332-7305 for general Program questions, Monday through Friday, between 8 a.m. EST/EDT and 5 p.m. EST/EDT or via wellborn@premierbus.com anytime. Messages received after 5 p.m. EST/EDT will be returned by next business day.

  • Privacy

    We will not share your personal information with outside parties without your consent, other than for purposes directly related to the Program including, but not limited to, third party Program service providers or providers who market products eligible for rewards. Please see our Privacy Policy at https://www.wellborn.com/extras.php?item=p for more information regarding how we collect and use your information.

  • Program Modification/Termination

    Participant should regularly review the Program Rules to ensure his or her awareness of any changes. By continuing to use the Program site and participating in the Program and receiving benefits thereunder after changes in the Program Rules have been placed on the Program site, Participant agrees to be bound by the most current version of the Program Rules.

    WB may, from time to time and in its sole discretion, modify or limit, in whole or in part, any aspect of the Program, Program Rules, participating partners or service providers, prepaid card(s), benefits, or special offers. The most current version of the Program Rules will be available on the Program site. Notice will be provided via the Program site or other method determined by WB in its sole discretion. The Designer’s continued access, use, and receipt of benefits under this Program constitutes his or her full and unconditional agreement to and acceptance of the Program Rules. In the case of a dispute over Program Rules and measurement, WB’s interpretations and decisions will be final.

  • Disclaimers

    WB is not affiliated with any manufacturer, retailer or service provider that is part of this Program other than the Wellborn Cabinet, Inc. branded products. No manufacturers, retailers or service providers listed in any marketing materials are sponsors or co-sponsors of the Program. Product providers and/or manufacturers may also provide additional terms and conditions associated with rewards that may or may not be displayed through the Program site. Designer is personally responsible for compliance with such additional terms and conditions. WB disclaims any liability associated with reward items, third party programs, websites, links, services, or products.

  • Copyright/Trademarks/Other Proprietary Rights

    All content (and the compilation thereof) included on the Program site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is and will remain, WB’s property or that of WB’s third-party suppliers, and is protected by United States and international copyright laws. Except as otherwise provided herein, all graphics, logos, page headers, button icons, scripts, and service names on the Program site are and will remain WB’s trademarks or service marks. All other trademarks not owned by WB that appear on the Program site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by WB. The Designer will not have, acquire or assert any rights in WB’s services, website, components or proprietary rights and will not, without WB’s prior written consent, copy, reproduce or distribute in any manner any of the content, data or information available through the Program site or services. The Designer will not remove or modify any copyright, trademarks, service marks, confidentiality or other proprietary notice or marking appearing on any materials relating to the Program services or website..

  • Disclaimer Of Warranties and Limitation Of Liability

    To the extent permissible by law, the Program site and all information, content, materials, products (including software), related systems and services included on or otherwise made available to the Designer through this site are provided by WB or other third parties on an “as is” and “as available” basis with no representations or warranties of any kind, express or implied, including, but not limited to, implied warranties of merchantability, description, fitness for a particular purpose, course of dealing, course of performance, usage of trade and non-infringement. Designer expressly agrees that his or her use of the Program site and participation in and receipt of benefits under the Program are at Designer’s sole risk and may be subject to change or removal at any time.

    WB does not warrant that the Program site; information, content, materials, products (including software), related systems or services included on or otherwise made available to Designer through the Program site will be uninterrupted, timely or free from errors, inaccuracies, viruses or other harmful components. WB, its suppliers, agents, employees, officers, directors and shareholders are not and shall not be liable to Designer or any third party for any damages of any kind arising from the use of the Program site or from any information, content, materials, products (including software), related systems or services included on or otherwise made available to Designer through the Program site, including, but not limited to, direct, indirect, incidental, punitive, or consequential damages.

  • In Case of Dispute

    By participating in the Program, Designer agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Program or rewards will be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program but in no event attorneys’ fees; and (c) under no circumstances will any Designer be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. The federal and state courts in Indiana will be the exclusive forum for any dispute regarding the Program or any reward. All entrants agree, by participation in the Program, to submit to the personal jurisdiction of the federal and state courts located in Indiana. This Program and any disputes or controversies arising hereunder will be governed by and construed according to the internal laws of the State of Indiana, United States of America, without regard to its conflict of law principles.

  • Release/Indemnification

    By using the Program site and by entering and participating in the Program and receiving benefits therefrom, Designer shall release, indemnify, defend (at WB’s sole election) WB and their respective directors, officers, employees, suppliers, agents and assigns from all losses, damages, penalties, costs and expenses (including, but not limited to, legal fees) caused by, arising from or relating to, the Program or the Program site, or a breach of the Program Rules by Designer.
